The basics of the patent is a diaper that is made of a water-proof outer and
a "stay dry" inner (any high or low pile polyester fabric that acts
as a barrier next to the skin to keep the skin dry) that is sewn on 3 sides and
has a pocket opening on a leading edge. Tereson Dupuy-Thomas is the inventor
and the patent owner. The pocket diaper can have any type of closure: snaps,
velcro- hook and loop- aplix, pins, snappie, ties, or anything else that could
possibly close the diaper.
What is a license? In order to protect the patent, any patent,
a patent holder will issue licenses to produce items that infringe on the patent.
This means that if anyone makes a pocket diaper that falls within the patent,
they need a license.
Who needs a license? Anyone who makes for sale a pocket diaper that falls under
the patent described above.
But I only made 3 pocket diapers last year for sale, do
I really need a pocket diaper license? Any wahm who makes for sale a
maximum of 5 pocket diapers per year does not need to purchase a pocket diaper
license.
I made my child some pocket diapers and she has outgrown
them. I have over 5 diapers, do I have to have a license to sell my own personally
used pocket diapers? No you do not need a license for this. I understand
that many people will make diapers for their own child. Privately sewn diapers
do not need a license, only diapers sewn for sale need a license.
I have a retail store and I sell several different brands
of pocket diapers that appear to be under the patent, do I need a license? No
you do not need a license to sell other people's pocket diapers. BUT they do
need a license to sell these diapers to you if they fall under the patent. If
you sell diapers that are not licensed yet do fall under the patent, you can
be held liable for any possible damages.
I make a pocket diaper but it is sewn on 4 sides with a
slit down the middle, do I need a license? If your pocket diaper does not fall under the pocket diaper
patent then you do not need to be licensed. It is your responsibility to provide
proof that your diaper does not fall under the patent.
I make a fitted pocket diaper, do I need a license? No you do not need a license
for a fitted pocket diaper.
I make a pocket diaper that does not fall under the patent
and I have provided proof of this, may I be listed on the pocket diaper licensed
wahms website? No.
